Events Participation Terms and Conditions

Alana Fairchild supports people seeking to become healers or expand their current healing skill sets.

Alana and her team run a combination of free and paid workshops and events (the “Events”) regularly to support the community on their spiritual and soul healing journey, and to experience Alana’s work as a support for that journey, translating her work in a meaningful way for their own personal experience.

This Events Participation Terms and Conditions (the “Agreement”) provides for the conditions of participation in any Event by Alana Fairchild and is a legally binding document between you (the “Participant”) and  Alana Fairchild Pty Ltd ABN 43 613 359 952 (the “Company”, and “Alana Fairchild”) upon the purchase of your ticket.

Terms and Conditions

1. Current Programs

Alana Fairchild Pty Ltd currently runs the following Events:

  • Free and online, and in-person workshops and events
  • Musical performances
  • Evening talks and meditations
  • Dance experiences

Payment Terms

Booking fee

1.1 A non-refundable booking fee may be required when booking an event.
Dates and location

1.2. Events may be delivered online or in person.
1.3. Confirmed dates and locations can be accessed on the website when the Event tickets become available.
1.4. The Company reserves the right to change venues to a venue of similar quality and location where a booked location becomes unavailable for reasons beyond the Company’s control.

Online events

1.5. The Company is not responsible for the reliability of your technology.
1.6. The Company may record online Events and provide the recording; however, not all online Events are recorded.
1.7. It is your responsibility to attend unrecorded “live” online Events.

2. Registration

2.1 By registering for any Event, you agree to all the terms of this Agreement.
2.1 Please contact [email protected] if you have questions about this Agreement or your chosen Event.
2.3 The Event registration fee does NOT include transportation to and from the event venue, any meals, or hotel accommodations unless otherwise stated.
2.4 The Company is not responsible for any losses you suffer for non-refundable travel. Therefore, you are advised to book any non-refundable travel AFTER the Company has confirmed your registration.

3. Cancellation and refunds

Significant planning, preparation and collaboration have been invested in planning Events by Alana Fairchild to ensure an unforgettable and unique experience for you. Therefore, we have a strict refund policy.
3.1 Notification of cancellation of your registration for the Event may be made in writing and sent to [email protected].
3.2 Any refund (if applicable) will be made via the same payment method as the original receipt of funds.
3.3 Where a cancellation is made six (6) months or more after registration, you may be required to provide supporting documentation, such as proof of purchase.
3.4 The notification must include all relevant information regarding the bank account to which a possible agreed refund may be remitted.
3.5 If the notification is received at least five (5) full working days or more before the date of the Event (“Final Cancellation Date”), the Company will provide you with a refund of the fee minus an administration fee of USD50. For retreats or workshops over USD$300, the Administration Fee will be USD75.
3.6 No refunds will be made for cancellations received after the Final Cancellation Date.
3.7 No refunds will be given for your cancellation or non-attendance at any part of an Event. This also applies to multi-day Events (held across more than one day).
3.8 The Administration Fee will apply to approved refunds and is in addition to any non-refundable booking deposit amount.
3.9 All cancellations and refund requests must be in writing by email to  [email protected].
Cancellations in the event of illness will require a medical certificate from a medical professional. 3.10 They will be subject to all fees above. Please include a copy of your medical certificate with your cancellation request.

Cancellation by Alana Fairchild

3.11 In the event of cancellation of an Event by the Company for reasons other than Force Majeure (uncontrollable circumstances as described in Clause 11 below), you will be offered an alternative date for a future Event, or you will be provided with a full refund.

Minimum numbers requirement

3.12 Where the minimum number of participants required for an Event’s viability is not reached, the Company reserves the right to cancel the Event.
3.13 In the event of any cancellation by the Company:
a) you will be offered an alternative date for a future Event, or
b) your deposit and all other monies paid will be refunded in full.

4. Consent to the use of video and photography image

4.1 You understand you may be photographed or filmed during your participation in any event.
4.2 You agree to allow your photograph(s), video, or film likeness, in its original, altered or enhanced state, to be used for any legitimate purpose by the Company.
4.3 Legitimate purpose includes, but is not limited to, marketing purposes such as website, promotional material for public display and distribution, media release, and social media (including but not limited to Facebook, Twitter and Instagram).
4.4 Please advise us if you do not want to be filmed or photographed during the Event.

5. Personal conduct

As an Event Participant, you agree to the following:

5.1 To conduct yourself with personal responsibility during any Event.
5.2 Respect our team and communicate any concerns as soon as practicable.
5.3 Should you engage in inappropriate, illegal or disruptive behaviour, you will be asked to leave the Event at your own cost, and no refund will be available.

Note:

  • Inappropriate, illegal or disruptive behaviour includes but is not limited to bullying, harassment, discrimination, and unlawful, disrespectful or violent or intimidating behaviour.
  • Any person includes but is not limited to the Company’s personnel and employees, the local community, other guests and participants.

6. Disclaimer
You understand and agree:

General

6.1 You have engaged the Company’s services and purchased the Event at your own risk.
6.2 All content, resources and coaching are provided for personal use and information only.
6.3 Alana Fairchild does not offer any representations, warranties, or guarantees, verbally or in writing, regarding your results from the Events.
6.4 The Company cannot guarantee your ability to get results, improve your spiritual practice or development, or otherwise with our mentoring, coaching, tools, ideas, information, or strategies.
6.5 Results depend on various factors, including but not limited to your current health status, commitment, personal ability, and dedication, and in no way dependent on any information or strategy provided to you by the Company.
Medical disclaimer

6.6 Alana Fairchild is a qualified spiritual teacher.
6.7 Alana Fairchild is not a qualified doctor, psychologist, or counsellor.
6.8 Alana Fairchild does not claim to diagnose or heal conditions.
6.9 The information provided in the Events is not intended to, cannot, and should not be expected to be a substitute for advice and treatment from a qualified medical practitioner.
6.10 If you have a physical or mental health condition, please ensure you are well, or your condition is appropriately managed to enable you to attend the Event safely and without risk to yourself or others.
6.11 Any information disclosed in the Events does not replace any treatment plans or protocols for diagnosed physical or mental illnesses or medical conditions.

7. Liability waiver and indemnity

7.1 You agree that the Company is not responsible for any loss, damage, cost, expense or other liability whatsoever incurred by you arising out of:

7.1.1 Injury, accident or death;
7.1.2 Any delay, inconvenience, loss of enjoyment, or frustration, whether physical or mental resulting from, but not limited to, any of the following factors:
a) The act or omission of any party, including Alana Fairchild or its employees.
b) Mechanical breakdown, government actions, weather, or other factors beyond the Company’s control.
c) Your cancellation or change of any travel services; and
d) Your medical or health problems or physical disabilities, stated or otherwise.

Release from liability<strong

7.2 You agree that the Company, its employees and assigns are released from all liability arising from any negligence or fault for your death, disability, personal injury, property damage, property theft, or actions of any kind which may occur to you, including your travel to and from the Event.

8. Assumption of risk

8.1 You are responsible for your own success and accept full and sole responsibility for your decisions, actions and results.
8.2 You understand and agree that the Company does not provide any implied or explicit warranty as to the truth or reliability of any material or information and any information provided to you during the Event and through any media.
8.3 The information presented is for educational and entertainment purposes only, and you assume sole and full responsibility for your own decisions and actions.

9. Force Majeure events (uncontrollable events)

9.1 A Force Majeure is an event outside our control that delays or hinders our ability to perform its obligations under this Agreement.
9.2 A Force Majeure includes but is not limited to fire, flood, earthquake or similar natural disasters, riot, war, terrorism, civil strife, labour disputes or disturbances, industry-wide material or services shortages outside our reasonable control, an outbreak of pandemic disease, governmental regulations, communication, technology or utility failures.
9.3 The Company shall not be deemed in breach of this Agreement for the delay in performing, or failure to perform, any of its obligations under this Agreement if such delay or failure result from Force Majeure events.
9.4 Upon any Force Majeure Event, the Company shall notify the  Participants of the inability to perform or delay in delivering and completing the Event.
9.5 The Company shall propose revisions to the Event schedule for completion of the Services or termination of services and this Agreement where it is determined that performance is not possible because of the duration of effect of the Force Majeure event.
9.6 Where services are terminated because of a Force Majeure Event, Parties agree every effort will be made by both parties to negotiate a financial arrangement to mitigate and share any loss resulting from the Force Majeure event.

10. Dispute Resolution

You understand and agree:

10.1 You will contact the Company immediately with any concerns so that they may be resolved quickly and effectively through friendly consultation.
10.2 In the event of a dispute, you agree to the following Dispute Resolution Procedure:

10.2.1 You must advise the Company in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute.
10.2.2 You agree to meet in person or via Skype in good faith to seek to resolve the dispute by Agreement and compromise.
10.2.3 If an agreement cannot be reached to resolve the dispute, any party may refer the dispute for mediation to the Law Society of New South Wales (NSW).
10.2.4 Both parties must attend the mediation provided by the Law Society of NSW in good faith to seek to resolve the dispute through mediation.

10.3 Litigation via the court process may only be considered after a genuine attempt at mediation, bought by either party, is unsuccessful.
10.4 Confidentiality is paramount to both parties’ personal and professional reputations and standing in their business and community.
10.5 At no time will any communications or discussions be made public, including but not limited to any social media platforms or websites of either party.
10.6 Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.

11. Governing Law

You understand and agree:

11.1 The Terms and Conditions of this Agreement are governed and construed under the laws of New South Wales, Australia.
11.2 Each party irrevocably and unconditionally submits to the exclusive jurisdiction of New South Wales.

By registering for this Event, YOU, the Participant, affirm you have read and understood this Workshops and Events Participation Agreement and voluntarily agreed to these terms.

Alana Fairchild Pty Ltd ABN 43 613 359 952 offers courses that support people seeking to become healers or expand their current healing skill sets. These courses are accessed by subscription to the Alana Fairchild Community of the Sacred platform (the “Site”).

These Terms and Conditions (“Agreement”) govern your use of the Alana Fairchild Community of the Sacred Membership site and form a binding contractual agreement between you as a site member and us.

You warrant that you are 18 years or above and have the legal capacity and authority to enter this Agreement.

Acceptance of terms
By subscribing, accessing, downloading or using the information, products and services offered on our Site, you agree to be bound by these Terms, which you acknowledge that you have read and understood.

Becoming a member
Registration
You can become part of the Community of the Sacred by registering your Membership via the registration process on our Site.
Membership is offered annually or monthly.
You must provide accurate, complete, up-to-date Membership registration information, as requested. In addition, you are responsible for informing us of any changes to your registration information.
We may, at any time, request a form of identification to verify your identity.
Password security
By becoming a Registered Member of this Site, you acknowledge and agree that:
You are solely responsible for the protection and confidentiality of any password or member identification that may be issued to or subscribed for by you from time to time.
You will not reveal (or cause to be revealed through any act or omission) your password to any other person.
You will notify us immediately if your password is lost or becomes known to anyone else.
You are solely responsible for all access to and use of this Site via your password, whether such access or use is by you or any other person, and
Any information you provide to us for posting or inclusion in our online Community at any time becomes our property.

Membership fees and payment
The current Alana Fairchild Community of the Sacred membership fee is as advertised on our website.
Where a member cancels Membership and subsequently requests to rejoin, they may do so at the current advertised membership fee on the website.
Payment of the membership fee is monthly or annually.
All payments are processed online via Stripe.
The Community of the Sacred does not retain credit or debit card information, and the information you provide for processing payment is managed by the Privacy Policy of the third-party payment processor.
Membership fees are in US Dollars ($USD).
The Community of the Sacred reserves the right to change fees at any time without notice. Please check the website for updated fees.
Existing members will be given 30 days’ notice of any fee change.
Unless stated otherwise, charges for any goods or services supplied (or offered for supply) via our website are stated inclusive of applicable taxes.

Content and delivery
Content is updated monthly.
Content is available to the member for the duration of the Membership subscription.
Upon cancellation, access to Content will cease to be available after the last day of the billing cycle of the month of cancellation.
Delivery
The primary delivery method of Content is through videos, emails and Lives.
Workbooks, templates and checklists are available via PDF downloads.
All live coaching is via Zoom and Circle and presented within the private Community of the Sacred Circle Group.
Membership announcements, for example, at the time of new module release, will be shared via email.
Content from time to time may also be delivered by email.
Member Obligations
Conduct
When using our Products and Services, you may be given access to our membership portal, Circle Groups, review services or other forums (Online Community) in which you may post comments, photos, messages or other material (Your Content).
When posting Your Content, you agree that you will not post or otherwise publish through this Site or our Online Community any of the following:
Content that is unlawful, fraudulent, misleading, deceitful, threatening, abusive, libellous, defamatory, obscene, pornographic, indecent, lewd, harassing, threatening, abusive, offensive, inflammatory or otherwise objectionable.
Content that harasses, degrades intimidates or is hateful to an individual or group based on religion, gender, sexual orientation, race, ethnicity, age or disability.
Information that includes personal or identifying information about another person without that person’s consent.
Information that constitutes promotion or advertisement for products or services offered through competing internet platforms and businesses, except as otherwise expressly permitted by us.
Any information or Content that impersonates any person or entity.
By posting or otherwise publishing Your Content on our Site or Online Community, you:

Whilst using this Site and/or our Online Community, you agree you will not:

Appropriate Sharing
You must remain mindful in your sharing and reserve any details of abuse or distressing situations for personal discussions with a counsellor or therapist, where you will be best supported in processing with a trained professional.
The Online Community is not a place to share graphic descriptions of distressing events, but you are welcome to share your emotional journey openly. We want your authentic story focused on what you have learned and what you want others to know so we can help people heal by sharing our soul wisdom with each other.
Our team will manage this Online Community as best we can, and we need participant mindfulness and sensitivity to ensure that the group can function optimally.

Sharing your story
If we determine your story could help others, we will request your permission to share with the use of your name or anonymously if you prefer.
If sharing a video, we may be able to use the audio only if you prefer your face not to be viewed on public channels.
Some participants will feel comfortable sharing more openly. Others will not and we respect both positions. We will work with you to ensure you are clear and comfortable with transitioning the Content from private community space into public sharing. Of course, we will always ask permission to engage in such a process.
If you wish to proceed, we will also require that you sign a waiver, signing over the rights to publish your story to us for our blog, our social media or other appropriate platforms such as our website or in other writing by Alana in articles, books, or spoken about in interviews.

Refunds

Cancellation

Upon cancelling your Membership, you will still have access to the Site until the end of the paid month or year.
Right to Terminate

Assignment
Transfer or assignment of your Membership for any reason is not permitted under this Agreement.
We may assign or transfer our obligations under these Terms at any time, subject to giving you four (4) weeks prior written notice.
Dispute resolution
Should a dispute arise between us, we strongly encourage you to contact Alana Fairchild at [email protected] to seek a resolution.
Any reasonable requests will be considered, and any outcome agreed to is at the absolute discretion of Alana Fairchild.
Alana Fairchild will attempt to resolve any escalated dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
Applicable law
These Terms shall be construed under and governed by the laws of New South Wales. You consent to the exclusive jurisdiction of the courts in New South Wales to determine any matter or dispute which arises between you and Alana Fairchild.

Online Healer Training Terms and Conditions

In these general terms and conditions (the “Terms”) the words “we”, “us” and “our” are a reference to Alana Fairchild Pty Ltd (ACN 613 359 952). These Terms apply to our courses, workshops and other training programs which we may offer from time to time, including Saraswati Healing™, Saraswati Healing™ Tantric Flow™, The Kuan Yin Transmission™, Rosa Mystica and Ma’s Kitchen short courses (“Courses”), and any online forums, communities and associated links, reference materials and training materials (including MP3s, videos, PDFs, music albums and others) (together with the “Courses”, the “Training Materials”).

Acceptance of the Terms
Upon registration for any Courses, or the purchase, download or use of any Training Materials you agree to be bound by these Terms. Your access to and use of the Courses and Training Materials is conditioned on your acceptance of these Terms.
By accepting these terms you agree to pay the Course fees (including GST) for the Course using the accepted payment method via the payment gateway.
You accept that you are required to pay the full amount of the Course fees even if you do not complete the Course.

Registering as a Business for Tax Purposes
When registering for a Course, you may, if you wish, register in your business name for tax purposes. You will be automatically emailed a receipt from the payment gateway upon payment. If you wish to receive your end-of-course certificate in your personal name, rather than business name, upon completion of your Course, you can add those details at that time.

Copyright and Intellectual Property
The Courses and Training Materials, all content on Alana Fairchild’s social media platforms and websites, all published materials, trademarks and implied trademarks, and any other materials you may obtain in connection with those items is our intellectual property (“Intellectual Property”) and will, at all times, remain our property and subject to copyright and other intellectual property rights under Australian law, international conventions and other laws. We expressly reserve all copyright and trademark in all the content of the Courses and the Training Materials, and we reserve the right to take action against you if you breach that copyright.
The Courses and Training Materials are provided to you (whether supplied by us or purchased by you) for your personal use only, and only for educational purposes. You are prohibited from using the materials for a commercial benefit, or to transfer or resell these materials in any way, unless you obtain express permission from us, such as under our practitioner’s license (the “Practitioner’s License”), where you are authorised to reproduce some materials in particular circumstances as expressly taught by us in the program.
All Training Materials and Courses are subject to change.

Lifetime Access to Training Materials
You have lifetime access to Training Materials once you have paid for your course in full. Upon completion of the training, you retain access to these resources and to any evolution in the teachings as new offerings are added. You agree that regardless of when you access the Training Materials they remain for your use only, and acknowledge and agree that downloading, purchasing or receiving any materials does not imply that they can be made public or shared with anyone else.
Lifetime access is subject to appropriate use of the materials. Access can be revoked at any time, at our discretion, for the misuse of materials. On rare occasions we’ve been required to remove participants from our community, courses or forums. If you are removed from our community, Courses or forums, your lifetime access to the training materials is revoked at that time as well. We reserve the right to remove you from our community, Courses or forums at any time.
Community Memberships
As part of your Course, and upon graduation, you will have the opportunity to participate in modality-specific forums, graduate forums or other online community groups. You agree that these have been created to give you the opportunity to explore your chosen modality more deeply, as well as opportunities to join community hosted live events and community-based planetary healing chains.
You agree that at all times you will communicate and engage with other community members, and with our team, with consideration, empathy and respect. We reserve the right to remove you from any of our forums at any time for any reason and will do so if those values are not met. There is no refund on membership and/or course fees to date should we need to remove you from the program and/or forum(s).
Practitioner’s License
Without limiting the acts constituting breach of copyright as set out above, the Training Materials may not be copied (unless for your own research or study), performed, adapted, modified or published in any form, shared, communicated over any medium, or distributed in the original or an adapted or modified form by any means, nor used for any public presentation or performance, class or workshop, nor may they be incorporated into any training program, other than as expressly permitted under the Practitioner’s License.
Enrolment in the Courses or access to the Training Materials does not grant you ownership of the Training Materials nor have we waived our Intellectual Property rights. If you obtain a Practitioner’s License to use the Training Materials commercially, you agree to acknowledge Alana Fairchild as the author of the material and we ask to give credit for the source of the work and use it only as you have been trained to use it.
Training Others in the Modality Techniques
You acknowledge and agree that you will not attempt to train others in any Training Materials or any of the modalities or techniques contained in the Training Materials, or deliver any of Alana Fairtchild’s training in this method, unless you have been authorised by us to specifically do so. These actions would constitute a breach of copyright, and we reserve the right to take action against you if you breach that copyright.
We have not authorised any other person to train the trainers other than Alana herself, and any other trainers that assist her will only be those that Alana has personally and expressly selected for the task, operating with her full knowledge and conscious permission, under her guidance. We ask that you refer people to the official program for online training with Alana.
Becoming a Licensed Practitioner
If you are interested in practicing any of Alana Fairchild’s modalities professionally as a healer, you may apply to become a Licensed Practitioner after graduation. We grant approval as a Licensed practitioner only once you have completed the full training in a specific modality (including assessment to our satisfaction, and through additional bridging work at our discretion if we feel it is required) and completed the relevant application and agreement forms for licensing and paid your license fee.
In order to become a Licensed Practitioner you must also maintain a Graduate Membership. The fee for the Graduate Membership is USD 111 annually. However, your one-time payment of USD 499 upon graduation from the course includes both your Lifetime Practitioner License (USD 388) and your current year’s Graduate Membership fee (USD 111). Each subsequent year you will only be required to maintain your Graduate Membership at USD 111 in order to continue practicing in your licensed modality.
The lifetime license fee of USD 388 gives you our official approval as a Licensed Practitioner and facilitator of the modality. It grants you permission to use the Training Materials and our trademarks solely in accordance with the Practitioner’s License, provided you maintain a valid license with us by honouring these Terms and the terms of the Practitioner’s License. To the extent of any inconsistency, the Practitioner’s License prevails.
Your Assessment
Before we grant a Practitioner License, we have an ethical and legal requirement to approve an assessment from the graduate. We want to ensure that graduates seeking to become practitioners have sufficiently understood and practiced the modality techniques essential for professional practice at a high standard. This assessment is due at the end of the modality training, with an additional two week grace period. By entering into these Terms, you acknowledge and agree to that requirement and that timing.
By accepting these Terms and Conditions you agree to honour your assessment due date, subject to the exceptions in this section. If there is any issue with completing your assessment on time, you agree to email the Training Angel immediately at [email protected].
Marketing
You accept and agree that marketing under your Practitioner’s License is solely your responsibility. Though your active Practitioner’s License entitles you to be listed on our publicly searchable online listing with details about you and which of Alana’s modalities you offer, this is solely for the benefit of consumers who wish to know which businesses we approve for affiliation under the relevant trademark.
If you enter a Practitioner’s License, as part of your licensing with us, you will receive an electronic marketing kit with a professionally designed logo for your use. We acknowledge that you are in no way obliged to market yourself using the suggestions within the kit, or at all.
You acknowledge and agree that you may use these promotional tools only for your work as a practitioner of the modality for which you are licensed, and agree that you will not associate the trademark or marketing materials with your work beyond that licensed modality. You further agree not to claim a general endorsement by Alana of your work, other than the general acknowledgement that you have successfully completed the training program leading to the granting of the Practitioner’s License.
In all circumstances, you agree that you are free to market your business as you wish, but that you will only use our trademark and modality techniques and training as set out by these Terms and the terms of the Practitioner’s License.
Official Alana Fairchild Designs and Material
When you become a Licensed Practitioner, you may receive official Alana Fairchild materials and graphic design templates for limited use within your business. You acknowledge and agree that you are solely responsible for all costs related to the printing and distribution of those items within your practice. You also agree to use good quality, high density premium paper – at least 170 gsm – in the printing of approved certificates for distribution to any modality workshop participants.
Insurance and Legalities
While Saraswati Healing™ and The Kuan Yin Transmission™ modalities are recognised by the International Institute Complementary Therapies (IICT) and are approved insurable modalities with AON in Australia, we cannot guarantee that you will have legal permission and/or be able to obtain insurance to practice the modality in all its possible applications in your unique situation or specific place of residence.
You acknowledge that the availability of any professional insurance or legal permission to practice any of Alana Fairchild’s modalities or spiritual healing generally may vary considerably from place to place and that we cannot guarantee that you will be able to obtain insurance or meet the legalities necessary to practice in your jurisdiction.
By entering into these Terms you further agree that nothing within can be construed as legal advice to you. We recommend that you seek qualified legal counsel for advice on the laws and regulations that relate to you specifically, well in advance of proceeding with your professional practice.
Cancellation of Your License

If you wish to cancel your practitioner’s license for any reason, you may do so by contacting us at [email protected] as soon as possible.
In the unlikely event of a breach of our practitioner code of ethics or the terms of our Practitioner’s License, we reserve the right to cancel a Practitioner License.
Legal Indemnity
Whilst we take care to deliver a quality program responsibly, by enrolling in the Courses, accessing the Training Materials, becoming a Licensed Practitioner and/or by becoming a forum member for a Course and/or community membership program, you acknowledge and agree that our liability to you is limited, to the extent available at law, to a refund of the cost of the training, or to perform the training again, at our option.
You further agree to indemnify and release us and our agents, including Alana Fairchild, from any claims, demands, and causes of action for:
a) death,
b) physical or mental injury (including aggravation, acceleration or recurrence of such an injury);
c) contraction, aggravation or acceleration of disease; or
d) the coming into existence, the aggravation, acceleration or recurrence of any other condition (including disease), circumstance, occurrence, form of behaviour, course of conduct or state of affairs in relation to you that is or may be harmful or disadvantageous to you or the community, as a result of your participation and enrolment in the Courses or access of the Training Materials, and you agree to indemnify Alana Fairchild Pty Ltd and its agents against any third party claim in respect of the above.
Training Cost, Payment Plans and Refunds
The cost of each Course and community membership option varies and are set out in the website. We also offer the option of paying via a payment plan, which allows payments in instalments. You acknowledge and agree that these payments are managed by a third party and cannot be customised.
By accepting these Terms you acknowledge that all costs are subject to change at any time.
Disclaimer
To the fullest extent permitted by law, we absolutely disclaim all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose. We give no warranty that the Courses or Training Materials will be free of errors, or that defects will be corrected, or that any of our online platforms, our website or its server is free of viruses or any other harmful components.
You acknowledge and agree that it is your sole responsibility to bear any and all costs of servicing, repairs or correction. The applicable law in your state or territory may not permit these exclusions, particularly the exclusions of some implied warranties. Some of the above may not apply to you but you must ensure you are aware of any risk you may be taking by using this website or any products or services that may be offered through it. It is your responsibility to do so.

You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
No Guarantee
We make no guarantee regarding the Courses or Training Materials or community membership other than any implied consumer guarantees that cannot be limited by law. In Australia, your rights to compensation will be governed by the Australian Consumer Law.
Competition and Consumer Act
For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), our liability for any breach of a term of this agreement is limited to the supplying of the goods or services to you again, the replacement of the goods or the payment of the cost of having the goods or services supplied to you again.
You must be over 18 years of age to use this website and to purchase any goods or services.

We may from time to time provide you with links to other websites or platforms. Refund Policy
By entering into these Terms you acknowledge that we do not offer refunds on any Course or Training Materials. We have already committed resources to you and places in the program are limited. Nor do we offer refunds if you are unable, for whatever reason, to complete the course or if we cannot offer you a Practitioner’s License. Australian Online Courses Pty Ltd complies with Australian Consumer Law in regard to refunds.
However our team wants to help you on your journey and we agree that we will do our best to help resolve any issues you may have.

Respect From and For Our Team
When we communicate with you, we agree to do so with consideration, empathy and respect, and by entering into these Terms you agree to do so as well. We have made a commitment to you and the community, to be here, to hold a light, to have compassion and to help each other as best we can.
Behaviour such as bullying, harassment and victimisation or that involves actions, words or physical gestures that could reasonably be perceived to be the cause of another person’s distress or discomfort is not acceptable. You acknowledge and agree that you will maintain consideration, empathy and respect throughout your time in the Course, in our forums and community groups, and at any time while operating under a Practitioner’s License.
In a community that regularly works with strong energies, we recognise that both blessings and difficulties can become amplified. It is our own consciousness that helps us work with that as constructively, and creatively, as we can, for best outcome. We encourage every community member to take personal responsibility for their energy and responses to whatever arises, whilst reaching out to our team with a collaborative spirit to create healing outcomes.
Whole Agreement
These Terms represent the whole agreement between you and us concerning your use and access of the Courses and the Training Materials. No other term is to be included in these Terms except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.
Exclusion of Unenforceable Terms
Where any clause or term above would by any applicable statute be illegal, void or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these Terms in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of these Terms in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.
Amendment of Terms
We reserve the right to change, modify, add or remove portions of these Terms at any time. Please check these Terms regularly to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our Training Materials or Courses then we will regard that use as conclusive evidence of your agreement and acceptance that these Terms govern your and our rights and obligations to each other.
Your Privacy
We are committed to protecting your privacy and adhere to Australian Privacy Principles as set out in our Privacy Policy.
You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers which also encrypts all customer information before it is sent to us. Furthermore, all of the customer data that we collect is secured against unauthorized use or access. Credit card information is not stored by us on our servers.
Disclosure of Your Information
We may be required, in certain circumstances, to disclose information in good faith. This requirement may come by law or by any court, to enforce the terms of any of our Practitioner’s Licenses or to protect the rights, property or safety of our customers or third parties.
Jurisdiction
These Terms are subject to the laws of NSW and Australia. If there is a dispute between you and us that results in litigation then you must submit to the jurisdiction of the courts of NSW.

Terms and Conditions - Courses

Alana Fairchild supports people seeking to become healers or expand their current healing skillsets.

These Course Terms and Conditions (the “Agreement”) is a legally binding contract between you (the “Participant”) and Alana Fairchild Pty Ltd ABN 43 613 359 952 (“Alana Fairchild”) and applies to the purchase of the Course referred to below.

You are deemed to have accepted the terms of this Agreement upon payment of your selected Course fee.

Three meditation albums (Radiance, Mystical Healing, For Love and Light on Earth), one for each module, and
one sacred music CD (Voice of the Soul )to support you energetically in the fourth module. These are available for download in an e-version if preferred to a CD.
2.8 Resubmission protocol
2.8.1 Participants may resubmit assessments if required.
2.8.2 There is no refund for failure to complete or pass the Course.

3. Fees and Payment
You understand and agree:
Payment options for the Courses are as follows:
3.1 Kuan Yin Transmission Foundations
USD1888 in full; or
USD472 for four monthly payments.
3.2 Saraswati Healing Foundations

3.3 Rosa Mystica Mother Mary
USD888 in full; or
USD222 for four monthly payments.
3.4 1:1 coaching sessions are offered provided by a Community Mentor. Fees may vary.
3.5 All fees are US Dollars and include GST (Australian Good and Services Tax) for Participants in Australia.
3.6 Payment is accepted by Credit Card (via Stripe).
Late payments
3.7 You are responsible for ensuring that payments are made on time.
3.8 Alana Fairchild reserves the right to cease Course access until the due fees are paid in full.
3.9 If an account is beyond 30-days overdue, Alana Fairchild reserves the right to turn the account to third-party collections to collect your debt and related legal fees.
3.10 This Agreement will be terminated, and no further access to the C will be provided.
Variation
3.8 Alana Fairchild reserves the right to vary fees at any time.
3.9 Changes in fees will not affect you and will only apply to a new round of course delivery.
Refund Policy
You understand and agree:
4.1 No refunds are offered for withdrawal or a change of mind.
4.2 If the circumstances (see 4.7) warrant and a refund request is made before the release of course materials, a refund less USD300 administration fee will be provided.
4.3 No refund is available after seven (7) days from any course’s commencement.
4.4 You remain liable for the remainder of the Course fee regardless of whether you paid in full or by payment plan. (Please see Refund Management for reasons other than a change of mind below).
4.5 Refund Management
You understand and agree:
4.6 Your commitment to your success and completion of your selected Course is required to gain maximum results from the Course.
4.7 Refund requests after seven (7) days of any course’s commencement will be managed according to our obligations and your rights as a consumer under Australian Consumer Law.
4.8 Refund requests will be considered on a case-by-case basis and are not guaranteed.
4.9 Where your payment method is via a payment plan, costs will be calculated and deducted from the total fees owing to the Alana Fairchild.
4.10 You will remain liable for the balance for payment owed to Alana Fairchild.
4.11 Failure to pay at any time is a breach of this Agreement, and we are entitled to seek legal relief and remedy for this breach and recover the debt owed by you.
4.12 Outstanding accounts and costs for collection will be referred to a third party for debt collection.
Day-to-day communication
You understand and agree:
5.1 Day-to-day communication for the duration of the Courses is via the private forum on Circle.
5.2 The private forum on Circle helps build connections and facilitate group learning, peer support, and education.
5.3 Unless your communication is personal or confidential, you are requested to post all questions, comments, and observations to the private forum on Circle.
5.4 With any private matters such as queries regarding the Course, accounts, or personal issues, please email [email protected].
5.5 We strive to respond to emails within 48 hours during business hours, Monday to Friday.
5.6 The Facilitator will aim to respond to group questions within 24 hours on business days only.

6.5 Boundary issues may arise during deep and successful inner work and give way to unconscious attention-seeking behaviours resulting in dominating discussion space or posting excessive causing discomfort in the group.
6.6 Excessive use in the forum may indicate that additional mentoring support is needed, and the person may not know the tone or degree of their engagement.
6.7 Please notify our team so additional support can be provided to the community and members.
6.8 Degree of detail in sharing personal experiences
6.9 We honour your courage in sharing whilst also asking you to consider your boundaries before posting.
6.10 If we have the sense that a boundary is being crossed, then we will contact you and seek to work through the situation with some practical suggestions such as mentoring.
6.11 The forum is a support space for the coursework and related matters, not a personal therapy group.
6.12 Personal sharing is welcomed, including about complex or challenging matters you are working through; however explicit personal information or detailed recounting of abusive or traumatic experiences should not be shared in the forum.
6.13 Such material is best to be held in a one-on-one therapeutic space. If you are unsure about making a post or are having difficulty with the content of another community member’s post, please contact the training team for guidance.
Revoking forum access
Our team will always attempt direct communication with relevant parties from a straightforward, caring, and compassionate place as the first step in resolving any conflict in the community.
6.14 In the unusual case that this fails to yield a satisfactory resolution of the issue, our team may temporarily revoke access to the forum as a cooling-off measure.
6.15 Our team will remain open to communication with a community member in cooling off to work through any issues and with the intention that the community member can return to the fray as swiftly as possible.
6.16 During cooling off, access to your course materials to continue your inner work will remain and mentoring may be offered.
6.17 No promotions or spam
6.18 Self-promotion, spam and irrelevant links aren’t allowed in this group.
6.19 Sharing of another creator’s work is not allowed in this group. Alana can only endorse and hold space for the practice of her work.
Respect from and for our community
6.20 We have a zero-tolerance policy for hate speech, trolling, bullying, or harassment.
6.21 Please notify the team immediately if you are experiencing this within the community environment.
6.22 If you have received unwanted, harmful or pointed negative comments from a community member, please do not engage directly with that community member but report the situation to our team immediately.

7.1 Alana Fairchild shall not be held responsible if there are any problems with the website or if the host or network should go down due to circumstances beyond our control.
7.2 When it is within our control, we will do our best to get the system back up as soon as possible.
7.3 Alana Fairchild shall not be liable to you or any other party because of viruses or malware that may infect your or any other party’s electronic equipment.

Course Portal
7.5 You will be required to register your details to create a password to access the Course content in Kajabi and Circle.
7.6 You are responsible for ensuring the details you provide are correct and current.
Password security
7.7 You are solely responsible for the protection and confidentiality of any password that may be issued to or subscribed for by you from time to time.
7.8 You will not share your password with any other person.
7.9 You will notify us immediately if your password is lost or becomes known to anyone else.
7.10 You are solely responsible for access and use of this Site via your password, whether such access or use is by you or any other person; and
7.11 The personal information you provide to the Course will be managed according to our Privacy Policy.

8.2 As a Participant and Practitioner, you are always bound to ensure that you do not breach our intellectual property rights for any reason.
8.3 You may not use any of the materials available in the Course or any teaching platform or in a manner that infringes any of our rights or has not been expressly authorised by us.
8.4 All material, including but not limited to videos, call recordings, resource downloads, and templates available in the Course and within any course created by Alana Fairchild, is provided solely for your personal and non-commercial unless you are Practitioner who has completed the required Course.
8.5 Practitioners may use the material for delivering the Course to their clients under license, and the use of materials is restricted to this purpose only.
8.6 Use of materials for any other commercial purpose is prohibited without the express written permission of Alana Fairchild.

Kuan Yin Transmission Foundations
9.16 Please note that the Kuan Yin Transmission is a unique integrative spiritual practice channelled by Alana Fairchild.
9.17 Whilst teachings from various traditions, including Tantric Buddhism and Traditional Chinese Medicine, inform many of the concepts that underpin the work, the modality is neither a Buddhist nor a TCM practice.
Medicine Heart
9.18 Please note that the Medicine Heart modality is a unique shamanistic healing modality taught by Alana Fairchild.
9.19 Medicine Heart is not a shamanic initiation course. Although you will learn a potentially valuable and rich technique and teachings that can deepen your personal and professional path, you will not become a shaman after completing this Course.

Limitation of Liability

10.1 Liability for the services provided by Alana Fairchild is governed solely by the Australian Consumer Law and these Terms and Conditions.
10.2 Nothing in these Terms removes your Statutory Rights as a consumer under Australian Consumer Law.
10.3 To the extent permitted by law,
Alana Fairchild excludes all express or implied representations, conditions, guarantees, warranties, and terms relating to any Services except those in this Agreement.
Alana Fairchild denies any liability in contract, tort (including negligence), or otherwise for any direct, indirect, special, incidental, or consequential costs, losses, claims, damages, expenses or proceedings incurred or suffered by you arising directly or indirectly out of or in connection with its services, including but not limited to any loss, damage or expense arising from any defect, error, imperfection, fault, mistake or inaccuracy with the information or advice provided by Alana Fairchild.
10.4 Alana Fairchild guarantees that all services are supplied to you with due care, skill, and fit for the advertised services.
10.5 To the extent that Alana Fairchild is unable to exclude liability; total liability for loss or damage you suffer or incur from services by Alana Fairchild and Alana Fairchild is limited to re-supplying the Services to you or, at our option, refund to you the amount you have paid for the Services to which your claim relates.
Dispute Resolution
You understand and agree:
11.1 You will contact Alana Fairchild immediately with any concerns for quick and effective resolution through friendly consultation.
11.2 In the event of a dispute, you agree to the following Dispute Resolution Procedure:
You must advise Alana Fairchild in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute.
You agree to meet with a key representative of Alana Fairchild in person or via Zoom or Skype in good faith to seek to resolve the dispute by Agreement and compromise.
If an agreement cannot be reached to resolve the dispute, any party may refer the dispute for mediation to the Law Society of New South Wales (NSW).
Both parties must attend the mediation provided by the Law Society of NSW in good faith to seek to resolve the dispute.
11.3 Litigation via the court process may only be considered after a genuine attempt at mediation bought by either party is unsuccessful.
11.4 Confidentiality is paramount to both parties’ personal and professional reputations and standing in their business and community.
11.5 At no time will any communications or discussions be made public, including but not limited to any social media platforms or websites of either party.
11.6 Any public discussion or comments about either party will be considered defamatory, harmful or otherwise damaging. They will be the subject of compensation in any mediation or litigation claim.
Governing Law
You understand and agree:
12.1 The Terms and Conditions of this Agreement are governed and construed under the laws of New South Wales.
12.2 Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts of New South Wales.
